Terms of Service

These terms set the ground rules for using Tripstead. The short version: use the app responsibly, verify important travel details with the original provider, and share only information you have the right to share.

Your agreement with Tripstead

These Terms of Service (“Terms”) are a legal agreement between you and Tripstead (“Tripstead,” “we,” “us,” or “our”) governing your use of the Tripstead iPhone app, website, and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service. If you use Tripstead on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

What Tripstead provides

Tripstead is a travel organization tool. Depending on the version and availability, the Service may help you create itineraries, store travel details, view maps and weather context, retrieve flight information, import possible itinerary details from an image or file, share a temporary trip copy, or collaborate through iCloud.

Features may be added, changed, suspended, limited, or discontinued. We will use reasonable care when making material changes, but we do not promise that every feature will always be available, free, compatible with every device, or available in every location.

Tripstead is not a travel agency, carrier, booking platform, insurer, emergency service, or professional travel adviser.

Eligibility, accounts, and devices

You must be legally capable of entering this agreement. If you are not old enough to agree to these Terms where you live, a parent or legal guardian must review and agree to them for you.

You may be able to use core local planning features without an account. Optional features may require an Apple ID, iCloud, Sign in with Apple, internet access, or compatible device settings. You are responsible for maintaining the security of your device and Apple account and for activity performed through them.

Provide accurate information when the Service asks for it, keep relevant contact details current, and notify us if you believe your access or information has been compromised.

Your trips and other content

You retain ownership of the itineraries, text, photos, files, links, and other content you add to Tripstead (“Your Content”). You give Tripstead a limited, non-exclusive licence to host, process, reproduce, transmit, and format Your Content only as reasonably necessary to operate the features you choose, protect the Service, and comply with law. This licence ends when the relevant content is deleted from systems under our control, subject to backups, legal retention, and copies held by other users or providers.

You represent that you have the rights and permissions needed to add, process, and share Your Content. Do not upload or share another person’s passport, payment information, private correspondence, precise location, booking details, or other sensitive information without authorization.

Temporary links and collaboration

A person with a temporary share link may be able to view the included trip information and import an independent copy. Treat links as private and send them only to intended recipients. Imported copies are controlled by the recipient and are not automatically changed or deleted when your link expires.

iCloud collaboration is managed through Apple CloudKit. People you invite may be able to view and edit shared trip content according to the permissions and functionality Apple and Tripstead provide. You are responsible for choosing collaborators and reviewing changes.

Verify important travel information

Travel information changes quickly. Flight times, status, delays, terminals, gates, weather, opening hours, maps, routes, time zones, addresses, prices, entry requirements, and reservation information may be delayed, incomplete, inferred, or wrong.

You are responsible for confirming important details directly with the airline, accommodation, venue, government authority, booking provider, or other authoritative source. Do not rely on Tripstead as your only source for boarding, border, visa, health, safety, emergency, or time-sensitive decisions.

Imported and AI-assisted details

Screenshot and file import uses automated systems to suggest possible itinerary details. Automated extraction can misread dates, times, locations, confirmation numbers, names, and other text. You must review and confirm every suggestion before saving or relying on it. Content inside an uploaded image is treated as source material, not as instructions to Tripstead.

Acceptable use

You agree not to:

  • use the Service unlawfully, fraudulently, or to harm, threaten, harass, impersonate, or exploit another person;
  • upload malicious code or content that infringes privacy, confidentiality, intellectual property, or other rights;
  • probe, bypass, disable, or interfere with security, rate limits, access controls, or service integrity;
  • use automated means to scrape, overload, or access the Service except through interfaces we expressly provide;
  • reverse engineer or attempt to extract source code except where applicable law expressly permits it;
  • resell, sublicense, or commercially exploit the Service without written permission; or
  • use Tripstead or its providers’ outputs to develop or train a competing model or service where prohibited by law or applicable licence terms.

We may investigate suspected misuse and cooperate with lawful requests from authorities. Reasonable security research reported responsibly and without accessing other users’ data will not be treated as malicious merely because it identifies a vulnerability.

Third-party services and links

Tripstead relies on or links to services operated by others, including Apple services, maps, weather, AI processing, flight information, hosting, and cloud infrastructure. Third-party services are governed by their own terms and privacy policies. We do not control their content, availability, accuracy, security, or business practices.

Links to airlines, hotels, venues, map apps, booking providers, or other websites are provided for convenience and are not endorsements. Any purchase, booking, communication, or dispute with a third party is between you and that third party.

Paid features and subscriptions

Tripstead may offer paid features in the future. Before any purchase, the app or App Store will show the applicable price, billing period, included features, trial terms, and other required details. Purchases made through Apple are billed and managed by Apple and are subject to Apple’s Media Services Terms and refund processes.

If an auto-renewing subscription is offered, it will renew unless cancelled through your Apple account settings within the period Apple specifies. Cancelling stops future renewal but generally does not retroactively refund the current billing period, except where required by law or Apple policy.

Tripstead ownership and feedback

The Service—including its software, design, brand, wordmark, approved luggage-shaped T mark, text, and other materials supplied by Tripstead—is owned by Tripstead or its licensors and protected by intellectual property laws. Subject to these Terms, Tripstead gives you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose.

If you submit an idea, suggestion, or other feedback, you grant Tripstead a worldwide, perpetual, irrevocable, royalty-free licence to use and incorporate it without restriction or compensation. This does not transfer ownership of your trip content or personal information, which remains subject to the Privacy Policy.

Suspension, termination, and deletion

You may stop using Tripstead at any time and can delete local content using the app’s controls. Removing the app may remove local app data, subject to your device backups and iCloud settings.

We may suspend or terminate access to online features when reasonably necessary to protect users or the Service, respond to legal requirements, address a material breach, or discontinue a feature. Where practical and lawful, we will provide notice and an opportunity to address the issue.

Sections that by their nature should continue—such as ownership, disclaimers, liability limits, dispute provisions, and obligations concerning prior activity—survive termination.

Disclaimers and limits of liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” Tripstead disclaims implied warranties and conditions, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and accuracy. We do not warrant that the Service will prevent missed travel, delays, losses, or other disruptions.

To the maximum extent permitted by law, Tripstead and its directors, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, lost data, substitute travel, missed reservations, or business interruption arising from the Service.

To the maximum extent permitted by law, Tripstead’s total liability for all claims arising from or relating to the Service will not exceed the greater of (a) the amount you paid Tripstead for the Service during the 12 months before the event giving rise to the claim and (b) CAD $50.

Some jurisdictions do not allow certain exclusions or limitations. In those places, these provisions apply only to the extent permitted, and nothing in these Terms excludes liability that cannot legally be excluded, including applicable statutory consumer rights.

General terms

Indemnity

To the extent permitted by law, you agree to indemnify Tripstead against third-party claims and reasonable costs arising from Your Content, your unlawful use of the Service, or your material breach of these Terms. This obligation does not apply to the extent a claim results from Tripstead’s own conduct.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have non-exclusive jurisdiction. If mandatory consumer law where you live gives you the right to bring a claim elsewhere or provides additional protections, those rights are not limited.

Changes

We may update these Terms. We will post the revised version, update the effective date, and give additional notice when a change is material or legally required. Continuing to use the Service after updated Terms take effect means you accept them, except where applicable law requires another form of consent.

Entire agreement

These Terms and the Privacy Policy are the entire agreement between you and Tripstead concerning the Service unless we expressly agree otherwise. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Tripstead may assign them as part of a reorganization, financing, merger, sale, or transfer of the Service.
